Judge declares mistrial after juror enjoys a beer

March 18, 2004 (Wheeling, West Virginia) — A juror could get a little thirsty listening to all those witnesses. But a long morning in court is no excuse for a beer.

A West Virginia judge has declared mistrial in a drug case, after a juror was spotted having a brewski during lunch. Judge James Mazzone says the thirsty juror was reported to a bailiff.



No charges are expected to be filed against the juror, who wasn’t named. Mazzone says he’ll schedule a new trail for defendant William “Willie” Mayfield, who’s charged with intent to distribute both marijuana and crack cocaine.


This truly is the only way to make it through a hearing.

    A mistrial for one beer? Is there some kind of precedence or law for this? I could *maybe* understand if he tested above the state’s BAC level, but this makes no sense to me.

    All this talk about lawyers and trials reminds of the time I tried to pass the Bar. I never could pass a bar without stopping in for a brew.

    Of course, we should ask our friend SATAN about what happened at this trial since he owns the souls of most lawyers. (or is that minions?)

    If the time on your post is right, you could use a beer. If you’ve got time to post in the mid-afternoon you need to come down and do some coding for my group there Ramdac my slacking friend….. or at least bring some beer down. We’ve even got a fridge to keep it cool. As if it would last that long.

    Me too. But atleast we all know if any of us are on trial to send the jourers lots of beer.
